Hiring a Vendor Without Insurance

Question:

When the Hoa Boards signs a contract to mow the common areas & golf course they say that the company they hired doesn’t have to have a certificate of Insurance
I don’t want them sueing us the homeowners if they have a accident in our property mowing
I asked to see the COI and they told me I would never see it. That it wasn’t my business
I’m a paying homeowner

Answer:

Hi Tena,

Kindly review the governing documents to verify whether or not vendors need a certificate of insurance to be hired. If the documents require vendor insurance, you may bring this up with the HOA board. If there are no requirements, you may raise your concern regarding the lack of insurance at a board meeting. The community may be able to propose an amendment to the governing documents to require vendor insurance. For further guidance, kindly consult a lawyer.
