Harassment, No Meetings, and No Records Inspection by BOD

Question:

Board members are a Mother/Son duo. Son is an FBI, they abuse their power with this, harrass residents. They just sent a Private Investigator, through the board member to my door. They refuse to give me Financials when I’ve asked, they do not have board meetings, they refuse to answer questions, they are deep in debt, don’t care for the property anymore. Board members or the HOA management ignores residents questions. What can we do?

Kindly speak with the board to raise your concerns by sending them a letter, speaking with them directly, sending them a message through mail, email, text, or call, or attending a meeting. You may also review the governing documents to verify their responsibility regarding sending financial statements and record inspections. Typically, homeowners have a right to inspect the records (including financial records) upon request. HOAs are also usually required to hold meetings at a certain frequency as mandated by the governing documents. As for the private investigator, it may be wise to consult a lawyer.

If they do not respond or refuse to cooperate, and if the association is incorporated as a non-profit, then the Idaho Nonprofit Corporation Act Section 30-30-608 states you may remove one or more directors with or without cause by a vote. Kindly also review the governing documents to verify whether there are specific requirements for director removal. For further guidance, kindly consult a lawyer.
