Question:
I was seated on my patio. Minding my own business
And 3 homeowners 1 is a board member 1 is a past board member and the other 1 is a homeowner who mows and has a contract with the the hoa board
2 of them came to my back gate and 1 to my side gate
Yelling and cursing and tried to get the lock off my gate and One stated he hated us and was going to kill my husband and he would dig the ditch to put him in thus went on for about 15 minutes there were other neighbors that witnessed it and hurt the death threat
I asked them to leave multiple times and they won’t leave finally they leave and in about 5 minutes the one that said the death threat came back again to my fence and kept yelling rude things and stated he hated us and would kill my husband
I wrote a email to the hoa president about this occurrence and he never responded
I did follow up with the police to let them know what happened
What can I do when our hoa broad will do nothing and they think that only themselves matter and they don’t even welcome new homeowners or they will not wave or say hi
What can I do?
I’m a paying homeowner and have about 7 homeowners that have never paid and our board dose nothing about it
Help a victim I’m scared in my own yard

Answer:
Hi Tena,
If others are harassing you on the basis of certain characteristics, then the HOA board is obligated to address the claim under the HOA harassment law. It may be wise to gather evidence of the harassment. You may raise the issue with the HOA board. Kindly also exhaust all forms of communication with the board including text, call, mail, and email. You may also attend a board meeting or visit their office to raise your concerns. If the board does not help, you may opt for dispute resolution or remove the problem board member(s).
As for the payments, it may be a case of selective enforcement. You may also raise this with the HOA board. It may also be helpful to raise awareness and gather support from other paying homeowners. HOA board members must enforce the rules, including the requirement to pay HOA fees. Likewise, if the board is unresponsive or refuses to cooperate, you may opt for alternative dispute resolution or remove the problem board member(s). For further guidance, kindly consult a lawyer.
