General Proxy for HOA Elections in FL

Question:

If a homeowner gives a general proxy to another homeowner, does that include the ability to vote on the ballot of candidates for office?

– Beverly

Answer:

Hi Beverly,

A general proxy permits the proxy holder to vote however they choose on any matter that may be discussed or voted on at a specific meeting. According to Florida’s HOA Act, the proxy must be dated. It must contain the date, time, and place of the meeting for which it was designated. The owner of the proxy must also sign the proxy form or ballot. Proxies are only effective for the meeting for which they were designated. They automatically expire 90 days after the meeting.
