Question:
We have a community clubhouse and a few of our residents have a poker game every week. Usually, participants are wagering with pots as big as a couple hundred dollars. Breaking any laws?
Thx for your help!

Answer:
Hi Steve,
There seem to be no HOA-related laws specifically addressing gambling in common areas. However, it may be wise to consult a lawyer as Delaware may have gambling-specific laws the community must abide by (e.g. minimum age requirements). They may also provide advice about any potential liability issues. It’s also best to review the governing documents to verify whether the community has rules related to gambling in the common areas.
