Extending Validity of CC&Rs in Colorado

Question:

This community has recorded CCR’s from September 29, 1960 and it states that the covenants are binding from a period of 25 years from when recorded, at which time said covenants shall be automatically extended for successive periods of 10 years, unless by vote of a majority of the then owners of the lots agreed to change said covenants. Does this means that it will automatically extend every 10 years? There is no ending date?

Answer:

Hi Vernette,

It seems that your interpretation is correct. However, since it is hard to determine what it means exactly without looking at the document, it is best to have your HOA lawyer take a look and give you advice.
