Excluding a Unit Owner from HOA Insurance for Nonpayment of Dues

Question:

If the HOA is responsible for insurance and an owner refuses to pay dues, can the HOA not pay their portion of insurance and leave that unit off the policy? If owner is not paying, HOA is carrying the cost of the insurance and mortgage company would be notified.

Answer:

Hi Danielle,

Generally, the penalty for nonpayment of dues does not include exclusion from the insurance policy. However, the exact consequences of nonpayment will depend on your association’s governing documents. Your collection policy should stipulate the penalties the HOA can impose if a unit owner fails to pay their dues. It’s best to follow the enforcement procedures outlined within your bylaws or CC&Rs.
