Can a HOA board restrict homeowners from being on the board

Answer:

Hi Jeff,

According to theĀ Texas Property Code, there are very few restrictions that can be imposed regarding eligibility for the Board. These include:

1. Bylaws may mandate that at least one board member reside in the subdivision, but they cannot require all members to live there.
2. In communities with more than 10 lots, two individuals from the same household cannot simultaneously serve on the board.
3. Board members convicted of a felony involving moral turpitude within the last 20 years can be removed from their position and barred from future service.
