Election Proxy Issue in Florida HOA

Question:

A board member delivered proxies, got mailed ones from po box, handled them, instead of president and vp. May hqve discarded ones that didn’t vote for her. Can we contact residents asking questions about their ballots/handling?
Can we petition for board to remove her? Fla laws were not followed.

Answer:

Hi Paula,

You may reach out to fellow homeowners to inquire about their proxy submissions and any irregularities they might have noticed. This can help gather information on potential mishandling.

Florida law permits the removal of HOA board members under certain conditions. According to Section 720.303(10) of the Florida Statutes, a board member can be recalled and removed from office with or without cause by a majority vote of the total voting interests.

If you believe that Florida laws governing HOA operations have been violated, you can file a complaint with the Florida Department of Business and Professional Regulation (DBPR). They oversee HOA compliance and can investigate alleged violations.
