Early Payments of HOA Dues in Maryland

Question:

Can the HOA board of directors forbid or others not allow advanced payment of HOA dues? I had been paying mine at least one year in advance for 8 years and now their bookkeepers are telling that it is no longer allowed.

Is that legal?

Hi Frank,

An HOA generally can tell homeowners when they can pay their dues. This also includes prohibiting early payments. Your HOA may have several reasons for this, such as for recording or tracking purposes. Maryland law currently does not prevent an HOA from prohibiting the early payment of dues. Talk to your HOA board to understand more and to see if you can ask to pay your dues earlier.
