Dues Paying for Golf Course Maintenance

Question:

Is it fair to make the homeowners in a development pay a privately owned golf course 40% of our quarterly dues in a 5- year contract? We have paid the golf course for 5 years and there are old golfers in our community that expect everyone to pay for the golf course. They are mounting their campaign and will hold another vote, but the quorum is only 30% for a special vote like this and it will be difficult to defeat them. My question is in regard to the legality of making homeowners pay a private corporation part of their dues when our infrastructure has been untouched for 15 years due to lack of funds.

Answer:

Hi Brenda,

If the golf course is owned by the HOA, then homeowners share the responsibility of paying for its maintenance. It is best to check your HOA’s governing documents to see how dues are calculated and divided.
