Question:
Can homeowners vote and HOA to set up a two-tier monthly management fee in a planned community and allow homeowners to opt out of landscaping services and do it themselves since they own their own property? A lot of homeowners are not happy with the service and are doing some of it anyways and would be nice if we could set up a two-tier system and save money that is otherwise wasted.

It depends on your governing documents. Your CC&Rs should outline who is responsible for landscaping in your community. If it is the HOA and homeowners would like to take over that responsibility, you may need to amend your CC&Rs to reflect that. The same goes for recalculating how landscaping fees are divided.
