Question:
Can a HOA Board discuss homeowners who are behind in dues publicly or does that need to be behind closed doors?
Are homeowners allowed to be present when the names of those behind in dues is discussed.
thanks

Answer:
Hi Cheryl,
While it is common practice to discuss delinquencies at closed board meetings, Kansas law does not expressly prevent common interest communities from discussing them at open meetings. That said, check your governing documents to see if there are any special requirements that apply to your association. Additionally, it is best practice not to divulge the names of delinquent homeowners to avoid violating their privacy. Instead, use parcel or lot numbers.
