Determining an HOA’s Status in Virginia

Question:

I live on Hanna Court – Hanna Estates- in Centreville VA and have been since the community was built in 1995. We used to have an HOA, but it has ‘disappeared’ over the last few years. How can I determine whether or not this is or was a ‘mandatory’ or ‘voluntary’ HOA and reinstate it if possible?

Hi Stefan,
If the homeowners association has filed with the Secretary of State, then you can do a search for your HOA and determine if it is still active here. You can also try to seek help from the Office of the Common Interest Community Ombudsman. As for knowing if your HOA is mandatory or voluntary, you can usually obtain that information within the association’s governing documents. Try to request a copy of these documents at your county recorder’s office.
