Defining Maintenance Duties of Limited Common Areas

Question:

In Illinois can Rules and Regulations be used to define maintenance duties for a Limited Common Area (LCA) that has been recognized within a Lake Lot (namely a Lake Bank and Shoreline as part of the Lake Bank).

Previously the Lake Bank was treated as a Common Area but the Homeowners were mowing the grass of the Lake Bank as an extension of their lot line across the Lake Bank, and the Rock Shoreline and Lake Bank have limited access only for the Owner(s) of each individual.

Your governing documents should indicate maintenance responsibilities as well as which components are general common elements, limited common elements, etc. Refer to your CC&Rs, bylaws, and community plat. If your governing documents are silent on the matter, you might consider amending them to include such definitions.
