Dealing With Difficult Owner and Lawsuit in Hawaii

Question:

What is the best way to handle a condo owner who sows division and conflict. He as already filed suit against a board member, and used a (former) board member to leak information to him. He says he represents a group of like-minded condo owners. However, he has not informed the board of who they are and acts as their self-imposed leader and spokesman.

He has run for board membership but has never had enough votes. He has accused the board of controlling the vote.

A part of his lawsuit asks that he be placed on the board without a vote, i.e., part of the settlement.

It is normal to encounter difficult condo owners. If the situation cannot be resolved amicably and the owner insists on pushing through with legal action, then your board should be prepared. Make sure you have proper D&O insurance to cover the cost of legal fees and other expenses. Hire a lawyer who has experience with HOAs and dealing with such cases.
