Charging Snow Removal to Only Affected Owners in HOA

Question:

Our HOA neighborhood had large amounts of snowfall that built up with ice layers and had to be removed from about 10% of our homeowners twin-homes. Can we require that only the units involved are responsible for the cost to their unit?

Hi Richard,

It depends on your governing documents. Your governing documents should tell you who is responsible for maintaining the various elements in the community. For instance, owners may be responsible for limited common elements whereas the HOA is responsible for general common elements. If your documents allow it, you can certainly allocate the expenses according to who is responsible for them.
