Question:
I am a home owner whose HOA fees have went up every year since we built in our neighborhood. Every year I pay my HOA dues. The HOA however always charges us late fees and interest if we don’t pay the dues all at once. If i am reading the law right LA revised statute 9:1147 Privilege A.(2) it says homeowners can pay monthly dues. The community management company stated the HOA board denied our request to pay monthly dues and have since fined us and given us late fees and interest. What can we do?

Answer:
Hi Derrick,
Kindly check the governing documents to see whether monthly payments are allowed. If not, then the homeowners will need to pay their assessments and fines according to the schedule outlined in the governing documents. You may also try to propose an amendment to change this rule. For this, kindly follow the procedure outlined in the governing documents. For further guidance, kindly consult a lawyer.
