Question:
When a candidate for the board of directors withdraws their name for consideration, what happens to votes already submitted by proxy, by secret ballot or electronically!
– Tom
Answer:
Hi Tom,
In these cases, it’s best for the association to send out a notice of the withdrawal so the residents do not waste their votes. Kindly consult the bylaws to see whether or not there is a special procedure the HOA must follow if a candidate withdraws after the election starts. However, if the governing documents are silent and the votes were already given, then the votes for the candidate who withdrew may simply be wasted. For further guidance, kindly consult a lawyer.
