We just bought a house in a Deed Restricted subdivision. It says in the restrictions that there is no HOA. Now we got a Welcome Packet that says they are forming an HOA and charging each homeowner $300 a year for maintenance for the mowing and fence line in front of the subdivision. Is this legal? How can they start an HOA without the property owners voting to have an HOA? That’s one of the reasons we bought our home here because it was a Deed Restricted and no HOA.

Typically, you can refuse to join an HOA if you purchased your home prior to the creation of the HOA. However, it would help to ask an attorney to look through your deed and deed restrictions to see if there is anything you missed.
