Can the HOA Board Pre-Approve or Overturn an ARC Decision?

Question:

In Texas, can an HOA Board review an ACC/ARC decision on an application before it is submitted to a homeowner for review and decide to uphold that decision or overturn it?

Answer:

Hi Rick,

Whether an HOA board can review and overturn an ARC/ACC decision before the homeowner is notified depends on the association’s governing documents. Generally, the Texas Property Code (Section 209.00505) allows for an appeal process when an architectural application is denied, but it does not require the board to pre-approve or override decisions before notifying the homeowner.
