Question:
Are HOA’s obligated to allow homeowner members to review contracts?
Are there any state contract laws that would prohibit it?
Thank you.

Answer:
A member’s right to copy and inspect records can be found under Section 14-3-1602 of the Georgia Nonprofit Corporation Code. This code applies to all associations organized as nonprofit corporations. However, the section does not include “contracts” as one of the records that members are allowed to copy and inspect. That said, you should check your governing documents for more information. It is also best to consult a lawyer for further guidance.
