Can HOA Prevent Building on Three Lots?

If a buyer purchase three vacant lots in a HOA subdivision, can said buyer and Village/City agree that buyer can build a single family house across two lots when the HOA Board of Directors
Disagree?

Hi Hardy,

Homeowners associations generally have the authority to regulate such matters. Check your HOA’s governing documents to understand your HOA’s powers. If the CC&Rs give the HOA the authority to deny such a request, then the HOA can do so. The exception is if city or local laws specify that an HOA may not regulate this.
