Question:
My husband and I have lived in a community that was built in 1987. We purchased our home in 1988-so we have been there for 34 years.
This entire time our HOA was strictly voluntary. There are 423 homes in this development. Four hundred homes are in North Carolina. Twenty-three homes-including ours-is in South Carolina.
Currently, the president of our voluntary HOA decided to bring in a management company. We were told that soon, the management company will be sending out notices stating our dues are now mandatory and supposedly all kinds of positive stuff coming our way!
Something doesn’t seem right though. We haven’t paid our dues in 3 years because the current president hasn’t sent any notices-he closed down the po box we sent the dues to so they were returned. We could never get in touch with him to deliver a check to. And now he is hiring a management company?
Doesn’t the community need to vote on this?
Can you give me advice on what we need to do? I am not opposed to mandatory dues but I am opposed to not having the right to weigh in on this.

Answer:
Hi Cheryl,
Hiring an HOA management company is typically not something that requires a vote from all homeowners. HOA boards can usually hire vendors, including management companies, at their discretion. However, it is worth checking your association’s governing documents to more clearly understand what your HOA can and can’t do.
