Can HOA Fine an Owner for State Law Violation in Texas?

Question:

I got a violation from my HOA because they said my political sign violated a Texas state law. My question is can they write me up for a violation of a state law.
In my opinion that would be like them writing speeding tickets within the subdivision.

An HOA can charge fines for violations that are found in the HOA’s CC&Rs, bylaws, or operating rules. Check your governing documents to see if it is really a violation. Some HOAs have a rule that homeowners can’t break state or local laws. If you have the same case, then your HOA can fine you.
