Can a Homeowner Run for the Board If they Have an Existing Violation?

Can a homeowner run for a vacant seat on the board of directors if he has a violation letter for painting his house without architectural approval?

After painting the house, this homeowner requested the ARC’s approval for the paint colors. He received a letter saying that he had violated the rules. The ARC reviewed the paint color and rejected it because it was the same color as the house next door. The rules state that no two adjacent houses can be the same color. There is an approved color palette from which homeowners can choose.

Hi Mark,

In California, it is no longer allowed for an HOA to prevent a homeowner from running for a position on the board based on good standing. As such, if a homeowner has a violation or unpaid fines, the HOA cannot prohibit them from running based on that alone.
