Question:
This is in regard to Montgomery County, MD HOA. No annual meetings in years. No president. No Vice President. No secretary. No meeting minutes. Unresponsive to community issues. Failed to perform a reserve study or contribute to the reserve fund. All board terms expired, but the Treasurer and an at-large member insist on running the HOA. Very low community involvement. Concerned, the expired members will nominate and elect themselves with a handful of votes. Local law states that if a quorum is not met on the first annual meeting attempt, a second meeting can be called and whoever shows up is a quorum. Even if only the nominees and a handful of others participate. in essence, they elect themselves.
I’m concerned the do nothing prior board will retain control and the HOA’s problems will remain unaddressed.

Answer:
Hi Stanley,
To address your concern about the board re-electing themselves, you and other concerned homeowners should act promptly to increase involvement. Encourage neighbors to attend the meeting, nominate new candidates, and vote. Even a modest increase in turnout can significantly influence the outcome.
Given your issues can be resolved with the right board members in position, it is essential to elect capable and competent individuals. They can then get started on getting the HOA back on track by conducting meetings properly, addressing community issues, performing reserve studies, maintaining the reserve fund, etc.
