Question:
I live at Mesa, AZ. We have two board members who have been on the board for ten years! I want this stopped. I don’t know how it developed, but it is unhealthy for our HOA. Where do I start with getting “term limits” on these two board members? One is in it for the money–he is a real estate agent and he gets all the referrals from the manager when a unit is going to go up for sale. The other board member does not even live in his unit! This just goes on & on. Please help us!

Answer:
Hi Patty,
Kindly review the bylaws to verify the terms of board members. If they were not re-elected and their terms are up, you may raise this issue and consider holding an election. The bylaws may also indicate whether or not the board member must reside in their unit to continue serving on the board.
The Arizona Condominium Act Section 33-1243(H)(3) states that unit owners may remove a board member with or without cause, other than those appointed by the declarant. You may consider removing the problem board member(s) by calling a special meeting. For further guidance, kindly consult a lawyer.
