Question:
Architectural Review Committee Has determined that the fence I want installed has to be within the setback of the property, on the side road side of our property. There are at least 7 other homes in close proximity of our house (2 blocks) where fences have been installed just inside the property lines. We feel this is discriminatory and not consistent with prior approved fence installations.

Check your governing documents and architectural guidelines to confirm whether or not such a rule exists. If you believe that your HOA ARC is selectively enforcing the architectural rules, then you should bring this to the attention of your HOA board.
