Access to Financial Documents for HOAs in Georgia

Question:

Georgia HOA not supplying financials to the homeowners. We just had our annual meeting, July 1, 2023 and no documentation was supplied outlining any financials. We only get that the community is in the red and the number of homeowners who haven’t paid dues. In order to see detailed financials we have to request a one on one meeting with the board. Board members are confrontational and I personally would rather not meet on a one on one basis for their and my own protection. What can I do?

Answer:

Hi Takisha,

If your association is a condominium, it is subject to the Georgia Condominium Act Section 44-3-102 which states that the HOA should provide comprehensive reports of the community’s finances at the annual meeting.

Apart from this, if your HOA is incorporated as a non-profit organization, it is subject to the Georgia Nonprofit Corporation Code Section 14-3-1620 which states that the HOA must provide a copy of the latest annual financial statements to its members upon written request or electronic transmission.

You may raise these with your HOA board.
